The  worst hit was Louisiana with a 59-percent hike.Almost a third of the people in the U.S. without health insurance work for  companies with fewer than 100 employees, according to a March 2008 population  survey. 			<description><![CDATA[To the dismay of many benefits administrators and employees, Section 3 of the Defense of Marriage Act (DOMA) limits marriage for federal law purposes to a relationship between a man and a woman. As a result of DOMA, same-sex spouses do not have the same rights under federal benefits or income tax law as opposite-sex ones. For example, 401(k) plans that do not offer an annuity must provide that upon a participant's death the account is to be paid to the participant&rsquo;s spouse, unless the spouse consents to another beneficiary. Because of DOMA, this protection does not apply to same-sex spouses. And under Sections 105 and 106 of the Internal Revenue Code, if an employer provides health benefits to its employees&rsquo; spouses, both the value of the spouses&rsquo; coverage and actual benefits received are excluded from employees&rsquo; income. Again, under DOMA, these exclusions do not extend to same-sex spouses, and the value of the coverage often must be reported as taxable income to the employee.]]></description>

			<description><![CDATA[ERISA intentWhen Congress passed the Employee Retirement Income Security Act of 1974 (ERISA), it made federal law the supreme law of the land as to the regulation of pension plans and as to certain employee welfare plans. Tucked neatly within the ERISA statute, at its inception, is a commonsense provision stating that if individual participants are given responsibility for choosing their own 401(k) plan investments, then the 401(k) plan's fiduciaries are not responsible for the participants' investment losses. For many years after the passage of ERISA, almost no notice was given to this provision.During the 1980s, as 401(k) plans containing participant investment direction features began to replace other pension plan vehicles, ERISA Section 404(c) became a subject of significant interest.The Dept Of Labor, (DOL) however, did not publish regulations concerning ERISA Section 404(c) until October 13, 1992, some 18 years after ERISA's passage. Today, 404 c compliance is a mainstay objective to most employers' plans.]]></description>

Private sector employers are generally subject to ERISA, which has procedural requirements for health plan claims and appeals of claims. However, ERISA does not cover health plans of governments, churches, and church-related agencies, as to which healthcare reform will impose new procedural requirements for claims and appeals. State law will set these rules for non-ERISA plans until the healthcare reform law is fully implemented, generally in 2012 as to claims and appeals. PHSA &sect; 2719, as added by the Patient Protection and Affordable Care Act as amended by the Health Care and Education Reconciliation Act, collectively called Healthcare Reform. The New Mexico Insurance Code has procedural and substantive provisions, and provisions allowing external review by the Division of Insurance of contested claims. NMSA &sect; 59A-1-1 et seq.]]></description>

On July 23, 2010, the Departments of the Treasury, Labor (&ldquo;DOL&rdquo;) and Health and Human Services (&ldquo;HHS&rdquo;) released interim final regulations for group health plans and health insurance coverage relating to internal claims and appeals and external review processes under the Patient Protection and Affordable Care Act (&ldquo;Affordable Care Act&rdquo;). These regulations are under Section 9815(a)(1) of the Internal Revenue Code (&ldquo;Code&rdquo;), Section 715(a)(1) of the Employee Retirement Income Security Act (&ldquo;ERISA&rdquo;) and Section XXVII of the Public Health Service Act (26 CFR 54.9815-2719T, 29 CFR 2590.715-27109 and 45 CFR 147.136). The&nbsp; following will summarize the provisions of these regulations.]]></description>
